My mom passed away 2 years ago in January and the will has yet to be probated because we can not find it. The mortage is being paid by myself and I am currently living in the house and how can I approach the mortage company with my interest in purchasing the house for myself? Also, the homeowners insurance policy will be ending soon and I can not renew it. How can I accquire home insurance in a timely manner? My current policy will not renew as the original owner no longer is living in the house. I am currently living here as I am caring for younger siblings (our father died as well) one of which is 10 years old. I am 28 yrs old with a succesful career and my finance is 38 and we are willing to purchase this house. I have tried to talk with mortage company but they will not speak to me as I am not my mom, the original owner. ANY HELP would be appreciated!

i think it is important for you to contact the lawyer who prepared the will and get a copy of the will from him if you are unable to find the will. because it is the prove that the property passes on to you after your mother.
once you get a copy of the will, you may contact the lender to show that you are the present owner of the property as your mother has passed away. then you may have to do a refinance to transfer the loan to your name.
if the present lender is not willing to work with you, you may shop for a while for some other lender who could refinance the mortgage in your name.
but the will is important. in case you are unable to find that, you may have to file an affidavit of heirship to get the title of the property in your name.

Yes, the will is the most important here. You have to get the will first. Then only you can buy the home. So contact the attorney who has prepared the will for you mother. He is the best person to help you out.
