Can bank forclose, sell my home, or make me pay after filing a 1099c and a Certificate of Release
Hi gsproduct,
You'll receive a 1099c form when the lender forgives the deficient balance resulting from the sale of the property. If you receive a 1099c form, then you'll be liable for paying taxes to the IRS.

I already received the 1099c it was for the full balance of the loan. I checked at the county recorders office and discovered that the mortgage company had filed a Certificate Of Release for the mortgage.
I called the mortage company and they told me " The house was mine and WE will not be coming after me for the house or the balance".
But she said WE.Since this sounded to good to be true.
Is it possible or LEGAL for them to have sold the debt to a collection agency before filing the 1099c for the WHOLE balance of the debt?

Hi gsproduct,
As they won't be able to come after you for the debt, they have sold off the account to a collection who can in turn collect the debt from you. You may have a word with a real estate attorney and check out his opinion in this matter.
Thanks

If you had received the 1099c form, then you'll be liable for paying taxes to the IRS. Any how have an proper consultation with the attorney.
