I have a first mortgage for 115000 and a second for 90000. House is worth 130000. If I do not pay my 2nd, will they forclose on me? If they charge off and send to collections, and if I cant pay the collections, will they garnish my wages? I live in California.
welcome robert,
if the second mortgage lender has the rights to foreclose the property if he does not receive the payments on time. however, if it's a purchase mortgage, then the lender won't be able to come after you for the deficient balance after the sale of the property.

I WANT TO STAY IN THE HOUSE BUT I CAN ONLY AFFORD TO PAY THE FIRST MORTGAGE AND NOT THE 2ND.
Hi ROBERT,
The second mortgage will not be forgiven in full by the second mortgage lender. Rather, you should try to set up an affordable payment plan so that it becomes easier for you to pay off the loan.
Thanks
