Threat of Foreclosure

Posted on: 21st Aug, 2009 06:34 am
My Soon-to-be husband is being faced with foreclosure. The property was given to his x-wife through their divorce. He was to be held harmless through the situation court documents prove that. We are still worried about whether or not they can attach his wages and try to put lein on things that we have together!!!! Help HELP HELP! I think legally we are protected but I'm not positive. This is a horrible situation. The best part of it is that when the judge awarded her the house she never had a job!!!! SERIOUSLY!!! Now the house hasn't been paid in almost two years and is owed over $23,000 in backed payments thats not to mention attorneys fees and other late payment charges ect. There is no way that we could step in and try to pay that....its gotten way out of control!!! HELP
Court judgement is the right answer to your situation. While on divorce, there should be clear mention of who will be the primary owner. And generally, one who owns the property has to be quit claimed by the other side. Once quit claimed, the responsibility of the person 'leaving the property' should end with the clear mention in the agreement.
Then there will be no foreclosure on his side and no need to worry after proper divorce agreement.
