i am a housewife, no job. my husband md. he is messing up our financial future.
got approval to refinance our home. all papers arrie with approval, case number, his name, i don't appear at all.
he says doesnt need my signature because i only appear as co-owner, not co-borrower (which is true). he would refinance now or at any time he wants and i dont even have to know about it.
i went to a lawyer who says that it should't? happen, but some banks would do it, specially now.
i called the bank, the person who prepared the loan and she said that if we are married it won't happen, but they continue sending papers.
my husband did the appraisal and everything seems to be underway.
please i need a simple plain explanation.
thankds, susan

If you DONT want this to happen, then you need to write a letter to the bank. There is a document that requires your signature which have been forged in the past by a spouse. If that happens, there is nothing you can do. You are fortunate enough to know this is happening before it is too late. So, if you send the bank a letter (find out WHO to send it to) indicating that you are aware of the potential transaction and that you do not approve of it, then the bank can be held liable if they proceed with the loan.
