I live in California and my husband died in march of '09. Since that time, I have paid the mortgage, but it is increasing each month and I have no income. I can not negotiate with the mortgage company because they say I am not on the loan and will not speak with me about the loan. But, I signed the loan documents. I need your help desperately.

the lender would not want to talk to you because you are not on the mortgage. you will have to refinance in order to put the loan in your name. in fact a refinance would have been a very good option for you given the current interest rates on mortgages are quite low. but since you do not have any income, you cannot qualify for a refinance. a loan modification would help you afford the mortgage payments and keep the house. but unless the lender is willing to talk to you, they will not agree to modify the loan.

you need to speak attorney. before that you need to analyze "Can you pay back mortgage from known source of income?"
