Hi,

A few years ago, my grandfather took money out against the house he owned. Somehow he transfered the house into my Aunts name before the bank could get the lean on the house. Last year, my Aunt gave the house to my mom, and now it is in her name. My grandpa just passed away in January. I was wondering what happens to the house loan he is suppose to have on the house? Is my mother responsible for this? She is not the execator of his estate. My uncle is and says my grandfather does not have any money out besides his car payments and a few credit cards, but my mom went to the bank with my grandpa and knows he had that loan. Any help would be greatly appreciated, thanks!
As the house is no longer your grandfathers, it does not form part of his estate. The mortgage will still be secured against the home, even though your late grandfather relinquished his rights of ownership to it. If the payments stop, the bank will take measures to foreclose on the property and recover the money that was borrowed against it.

Regardless of who owns the property at the moment, the bank still has a secured interest against it and has the right to enforce recover of the debt in the even of payment default.
