I am a first time home buyer in escrow and just found out that I have to get a quickclaim deed signed by my "husband" who is in prison. I am racing against the deadline for the tax credit and really have no idea what steps I need to take to get this taken care of. We haven't spoken in almost 10 years. I have no idea where he is but do know he won't be out for another 20+years. Does anyone know the steps I need to take in order to resolve this quickly?

Hi Andria,

m not sure why you need to get a quitclaim deed signed by your husband. The first time buyer tax credit of $8k is meant for those who have not owned a primary residence for the past 3 years. In case you are an existing owner and have owned the property for the last 5 years, you can qualify for the tax credit of $6500.

Is your husban name on the title to the new home youve bought? Is he on the title to the existing home? Why do you need him to sign a quitclaim deed in order to qualify for the first time buyer tax credit?
