getting the house in divorce?

i'm getting a divorce and my ex says i can have the house. we bought it together 3 years ago with a gift from my parents for the down payment. do i have to refinance to get her name off the mortgage, then work to get her name off the title? how does this work and where do i start?

Hi,

After you removed her from loan by refinance mortgage. Then You have to sign a quite claim deed to remove her name from property deed.
Record this deed in country records to make it validate.

actually, you'll be unable to refinance in your own name without having the property in your name only. you'll want to coordinate the quit claim deed with the refinance transaction so that they happen simultaneously. whoever you will seek your mortgage from must be aware of what you're doing so that the closing agent who handles the closing will be able to do what is necessary.
