my mother died and before she died she did a quit claim deed what right do i have to the property and there is still a mortgage on the property would my name appear on the title from her quit claim deed to me

Sorry to hear about your mother. You will have rights and title to the property in your name. You need to get the mortgage transferred in your name. Consult a real estate attorney on the matter.

Yes title to the property can be transferred even if there is a mortgage on the property but you won't have the benefit of an owner's title insurance policy to be certain that you get a marketable title.

Did you talk to the lender? Explain him the situation. He can suggest you to get the mortgage transferred in your name. Also do consult a real estate attorney to see that you can have a clear title to the property. Advices and guidance from professionals are always required to handle real estate transactions.

Don't worry you just need to take care of the mortgage payments and you will get clear possession over the property.
