Hi,
Welcome to the forums.
Each and every state in the United States has property exemption laws that protect some of the debtor's assets from being taken over by the creditors. These laws are known as the bankruptcy exemption laws. Your bankruptcy attorney will be the best person to let you know about the exemptions and also about how you can protect your property.
When you file the petition for bankruptcy, you should list those exemptions along with your personal information, income details and assets, expenses and all your debts.
Hope this is clear to you. Let us know if you have any other query.
Thanks,
Caron.

Hi,
If you wish to protect personal property, contact the lender and let him know that you wish to retrieve the personal property on a certain date and time. If the lender does not agree, you should ask your attorney to contact the lender requesting him to release your personal property. Or else, you can take a formal letter from the attorney demanding the release of personal property and hand it over to your lender.
Regards,
Jessica.

Hi Laura,
You can file for a divorce but it can be a mess with a mixture of a divorce and bankruptcy. Both of you should try to achieve a compromise and reach a fair settlement while going for it.
Consult your bankruptcy attorney and take his suggestions on the matter before you file for the divorce.
