QUIT CLAIM FROM MOTHER

Mother quit claim house to daughter and self. Then she died. Daughter witnessed the quit claim notarized and filed with county. Mother created a will stating the house should go to daughter, daughter tries to sell house title company say's no. quit claim is no good. only a copy of the will. Will is witnessed and nototized. daughter wants to sell the house without probate now!

you said that the title company accepts the will. also you mentioned, the will states that the house goes to the daughter.

so, where is the problem now? you don't need any quit claim deed at present i believe in the presence of the will.

Hi,

I believe that the title company didn't agree to the quit claim deed as a quit claim deed doesn't warranty whether there is any lien in the house.

Hi,

I don't think there is any need for a quit claim deed when the Will already states that the property will pass on to the daughter. This gives the daughter the rights to sell off the property.
