If a deed is not recorded before the grantor dies, it is usually accepted that the grantee has no consent to this deed. The deed is recorded as invalid if the grantee cannot show any proof regarding the delivery and acceptance of the deed. Is this true in Illinois?

Hi Linda,
It is true in Illinois also, for the quit claim to be valid it must be recorded before the grantor dies or it will not be a valid document for transfer of interest.
If the deed is not recorded other people will not be aware of your legal interest in the home. Recording the deed acts as a proof of the transfer of interest.
Thanks
James

it's true for any state in the us not just illinois.
when a quit claim deed is filed in public records, anyone can check the records later on to verify if the deed was actually signed. but a deed without being recorded cannot be taken as valid and the grantee fails to prove that the interest in a property was actually transferred to him.
thanks

CAN QUITCLAIM BE RECORDED AFTER THE GRANTEE DIES
I QUITCLAIMED A DEED TO MY SON FOUR YEARS AGO. HE SINCE HAS PASSED AWAY WITHOUT RECORDING THE DEED. DO I GET THE DEED BACK, OR CAN ANYONE RECORD ON HIS BEHALF AFTER HIS DEATH.
