Im about $35,000 in debt and make around $3,800 a month bring home. After paying for house, car, utlitys, food, ect. I have around $500 left over. Is this enough of a payment to file chapter 13? A chapter 7 lawyer told me it would tkae $700 or more a month and i should file chapter 7 over 13? Is he jus trying to get me to go with him or is he telling the truth?

I think you should have asked a Chapter 13 lawyer regarding the payments. A Chapter 7 lawyer may not be able to give you exact information, as he does not deal with it.

The monthly payments for your repayment plan will cover the amount that is left to you after you have paid for the daily expenses including your debts and liabilities.
The bankruptcy trustee appointed by the court and your creditor need to approve the plan before you start making the payments. So first of all you should contact a bankruptcy attorney to know how you should proceed with filing.
Check out for more on Chapter 13 before you intend to file.
