The foreclosure process is actually started by lenders and not by borrowers. Every state has different laws on foreclosure according to which the whole process varies. In some states, the foreclosure is conducted through the court system (judicial) and in some others, it is done outside the court system.
The foreclosure process starts with lender filing the necessary court action against the borrower who is in default. This is actually done in the form of a lawsuit against the borrower.
