who does the deed belongs to?

Hi
Question:My uncle past away about 2yrs in va...searching thur the records i found that a person that has the same name as my dead uncle in another city of Va...i went to the town and got a copy of the deed...in which it has the same name and middle initial and last name as my dead uncle...how do i go about finding out if this is my uncle property?

I think you should consult an real estate attorney who would be able to provide you with details on how to find out whether the property is actually in your uncle's name or not.

You can contact the local property assessor's office or the auditor's office for information about the actual property owner's name and mailing address. This way you will know whether the property in whose name the property is listed is actually your uncle or not.

Hi,

Your uncle must have signed on the copy of the deed. You should try to check the signatures of your uncle and the other person. Your uncle's bank statements or other legal documents can help you to detect his signature. You may find such statements with your relatives also if you are unable to get the legal papers.

By verifying his signature, you can find out if the property belonged to your uncle.

I AM BUYING A HOME AND THE MORTGAGE LOAN WILL BE IN MY NAME ONLY. IF I ADD MY FIANCEES NAME TO THE DEED, BUT NOT THE LOAN, WHAT RIGHTS WOULD HE HAVE TO THE HOME?

Hi Ann,

If you add your fiance's name on the deed, he will have ownership rights on the home. But he cannot sell off the property until and unless the debt against the property can be cleared by you.
