Reclaiming Quit Claimed Property

My mom and step father quit claimed me thier home 2 years ago. My mom just passed away and now my step father is trying to say he didn't know what he was signing because he can not read. That is not the case. I have even been paying the insurance and taxes for 2 years. He thinks he has all rights because it was his. What rights if any does he have? Can he say he didn't know and would the courts give it back to him?

Hi,

Courts will not give the property back to him just because he says that he did not know what he was signing, he will have to prove that he was made to sign the deed under pressure or any other unfair means.

Proving the deed to be invalid lies upon him and if your step father tries to take possession of the home, you can take him to the court.

After your mom and step father quit claimed it to you, he doesn't have any right to claim the home as his own.

hi,

your step father can say anything that may help him take away the property from you. but what matters is the written agreement. you must have a copy of the quit claim deed with you. so, you can provide the court with a written proof of the property-transfer if required. thus, the court cannot give away the property back to your step father in the presence of a written evidence of that transfer.
