I was abused and stalked by a boyfriend that I have right to survivorship and joint ownership in property,,,there r 2 homes on the proprty,but afraid to live there,,I have no money,,,i need help getting my share,,how do i do this,,,I didn't him arrested just restraining order,,order has expired but still afraid,,please I only have a few days to get this done,,please answer asap...the state is tennessee,,,,tahnk u..

I think till the time you get justice you can either live with your parents/friends or co-ops so that you will feel protected.

Best part to get your share is to fight a legal battle.As you have stated that you do not have money,but in my opinion you ought to have some amount of money to file a case in the court.(even if you get a free legal advice from an attorney) ...I am just trying to be practical..

So, if you have right to surviorship/joint ownership you will surely get your share and you can opt for cash, once the property is sold.(It is better advised to sell off the property and then with the cash in hand you can always search for a new home where you will find safe enough from your boyfriend)

Coming to the second query...if police has issued the arrest warrant for the specific period then if the person is not found within that period they can reissue it.So you can pursue this matter with the police officer..

You should immediately contact a real estate attorney and take his opinion in this matter. The attorney will guide you in order to know how you can recover your share of the property.

I don't have information on Legal Aid, but you can check to see if there's available free legal representation in Tennessee. If there is, by all means, you ought to take advantage of it. That will help you settle the issue with the property.

You cite the right to survivorship as if it's valuable to you at this time. Yes, it has value, but it's only going to kick in upon death; so please don't get worked up about that.

A restraining order that expires does you no good whatsoever, and I'd have to think that he knows that as well. Shortly, you'll be looking for another one, at least based on what we have learned through the years about abusers.

Be very careful - get legal help and make sure that you protect yourself.
