Quitclaim fraud???

Posted on: 22nd Oct, 2006 03:29 pm
My ex-husband owes me about $60,000 in back child support. He quitclaimed his home to his current wife, to avoid his financial obligation to me obviously. Do I have any recourse?
Hi Susan,

If your ex-husband has already transferred her property interest to his current wife, then you won't have the rights to that property. Well, you can have a straight talk with your ex-husband and remind him about the child support. However, if he doesn't agree or shows his inability to fulfill the financial obligation, then you better talk to an attorney dealing with this issue.

Thanks,

Sara.

Hi,

As per law you can take him to court for not meeting his obligation to pay you child support. Regarding quit claim of the house, even if the house is transferred in his current wife's name, his obligation is not removed.
