What rights as second wife to house?

FL...The house is titled to my husband & ex-wife. We are married 26 years. They were married 12 years. He was given ownership to pay off the mortgage and maintain house at his expense. We are both in our senior years now. What rights do I have on the event of his demise (or before) while ex-wife is still alive?

In case of his demise the house will be divided to have his ex-wife her half share which she was entitled to and the other half which belonged to your husband will be given to the person or person's named by him on his will for the distribution of his share in the house.

Normally as the spouse you would be the sole heir to the share of the house your husband.

You should ask your husband to make out a will assigning his part of the house in your name to avoid any complications when the house will need to be divided.

You can ask your husband to add your name to the title by signing a quit claim deed. In that case, all the three of you will have ownership rights on the property in accordance with your share of interest in it. Or else, your husband can also take his ex-wife's name on title by asking her to sign a quit claim, in which case, only you and your husband will have rights on the property.

Alternatively, you can also claim your rights in front of the court officials. But then, it is a long process and it's going to cost you a large amount of money. So, I personally feel you should avoid the court proceedings.
