My ex and I have a home in TN. My name is on the mortgage and the deed. We split up about a 1 1/2 ago and my name is still on the house making it difficult for me to get a mortgage. Thus I have to rent. Is there anything legally I can do to force him to refinance (which he says he can't afford to do) or sell the home? He has been paying the mortgage since I left. Any advice?

You cannot force him to refinance when he cannot afford it. You will have to convince him to sell off the home which will help you in removing your name from the mortgage.

I agree with Sussane that you will have to take steps to convince your ex to sell off the property. You can never force him to do anything.

Give us a call, we run into this problem all the time. All we have to do is show that he has been the only one making payments on the mortgage and you have lived elsewhere. If you have it in writing that he received the house in the divorce that is an added benefot for us to show the UW.
