My wife and I bought a manufactured home before we were married but it is only in her name because I had a bankrupsy, we moved to we moved to Florida Nov 2012 and were married Aug 2013 now we are seperated and getting into the divorce I still live in the home and have made every payment and lot rental payment both to the mortgage holder and to the co-op in my name since 2012 now I understand she just gave the house back to the real estate or mortgage holder without notifing me for nothing, Im currently up to date with all payments for the month of April 2014 can she legally do that, and do I have any rights to get the house back since there was no sale? Your help would be greatly appreciated, alone in Florida.
Seek out a resl estate attorney in your area - my guess is you have no right since you are not on the title/note - if you had a divorc agreement that said you get possession it may help but even then the mortgage supercedes that and it may not be enforcable (divorce agreement)
