I have a deed with mine and my common law husbands name on it, NY common law for 25 years, I have been seperated from him for 20 years also and now reside in another state. Recently he passed away leaving no will.

I have a home and do not require another, do I have the legal rights to this property, and am I allowed by law to quit claim said property. My common law husband never remarried, and again left no will, am I now the sole owner of same.
Since your name is on the deed, so you have some legal rights on it.

As your common law husband has not made a will and your name is already on the title of the home, you have legal rights over the home. You will also be able to quit claim your share to another person.
