Quit Claim deed processing if the property in Florida.

Posted on: 02nd Mar, 2007 05:30 am
my brother lives in hawaii & i live in illinois, we have an empty lot in florida and the deed is under both my brother & i. my brother wants to transfer the property to me. can you tell me how to go about processing the quit claim deed if the lot is in florida?
Hi Dinah,

Welcome to Mortgagefit forum.

For transferring that empty lot in your name your brother will create a quit claim deed to transfer his share over to you. After the deed is made out you need to get it notarized and recorded in the recorder's office in that county where the lot is situated.

You might be thinking of recording it where you are living now but it will have to be recorded in the county where it is located. After it is recorded in the county recorder's office, the property ownership records will show your name instead of both of you being named as co-owners.

While drafting the quit claim deed I would advice that you consult an attorney to correctly create it. Also go through this page to know more about quit claim deeds - http://www.mortgagefit.com/quitclaim-deed.html
