Quit Claim Deed

i got divorced 9 years ago. i signed a quit claim deed. because we never parted or sold the house like the divorce decree stated............he said i am still on the mortgage (which is almost paid off ) and still on the title.

how can that be?

Do I still have legal rights to this house. He said because the house was never sold like the Divorce Decree stated it is still half mine!

Hi Pwarren,

Welcome to the forums.

I am not sure at this but it seems that you were the owner of the house along with your husband. You said you have signed a quit claim deed. But what was the purpose? Did you want to transfer a portion of your property interest to your husband as stated in the Divorce Decree?

As far as the mortgage is concerned, well, you cannot get out of it if your name is on the loan even after signing the deed.

If you can explain the reason of doing the quit claim and whose name is on the loan, then I can come up with better suggestions.

As of now, I think it will be better if you go through the deed and try to find out what it stated legally. If you still can't solve the dispute, you may approach a title company, let them do a title search on your property and find out who is actually on the title.

It can happen that your ex did not complete the procedure of recording the deed with the county recorder's office. That is the reasons your name is still on title of the house.
