Hi Yolanda,
Is there a mortgage on property in MS? If there is a mortgage on it, your husband can reaffirm it under the bankruptcy and keep making payments towards it. So long as he is current on the mortgage, the home will remain secure from foreclosure. If he does a deed in lieu on the property in FL and there is a deficiency from the sale of the home, he will be liable to pay it off. In case he does not pay off the deficiency, the lender may obtain judgment against him and come after his property in MS.
Hi Guest,
The process for a deed in lieu is not as complicated and time-consuming as a judicial foreclosure. In a deed in lieu, you simply sign over the title to the lender and give them the keys. They take the ownership of the house and sell it off to recover the mortgage balance. As far as the length of time for a deed in lieu is concerned, it depends on your individual lender.
