Affidavit of Due and Diligent Search
what do you want to say?
Welcome Wendy,
Diligent search is usually made for absent parents so that they can be informed of all actions the Department of Health and Human Services will be taking for their children. Parents are informed so that they have the chance to take necessary actions. An "Affidavit of Due" states a written declaration of having payment due made under some oath.
it's basically saying that someone made every attempt available to them to find someone else. like if a bank kept sending payment notices but never got a response then they would say we tried everything to contact the borrower.
or if a borrower was trying to contact a lender and the did not respond. then this would also apply. how can you make your payments if you can't talk to the lender. in example. a predatory lender who doesn't want a borrower to refinance and won't send out a payoff amount.
