Who to contact at BofA for Settlement of Debt on Second Mtg

bofa has screwed us up and delayed our short sales. we have lost eight buyers in the past year. bofa is the second mortgage lender and is totally unsecured by any equity. i have file bk7 and have wiped away their note. but the mortgage remains. so, i would like to make them an offer to settle and release the mortgage. but, no one i have spoken with at bofa knows who to work this out with. most say it can't be done - they don't settle! if you know who to contact to settle this out, please give me a name, title, department, phone number, and email address.

It is the customer service representative at BoFA who will be able to let you know whom to contact for settlement.

What a stupid answer. Customer service at BofA is by far the industry's worst, most inept, poorly trained liars.

Well Skeeter... unless the customer care division is contacted, how will the person know whom to contact for settlement?

Depending on the state you're in you could be protected by certain anti-deficiency laws from your second mortgage. If it was included in the bankruptcy and they're still trying to collect from you then they're probably breaking several laws in the FDCPA, RESPA, and TILA. If it's still reporting on your credit with balance owed and not reporting as having been included in BK then they're probably also breaking laws in the FCRA.

From our experience BofA is pretty bad about this stuff. You have to dispute it and bring the consumer laws to their attention. It's a little more complex than just sending one letter. So if you feel you need help it's best to contact a professional like myself.
