I(individual) filed for Chapter 7 and was discharged Oct 2010. My future ex husband wants to attempt to modify the loan under his name only. If I was to modify the loan along w/ me will that breach the bankruptcy? If I don't do the modification w/ him and I sign a quick claim deed, will that breach the bankruptcy?
Hi Guest,

As you have filed bankruptcy and got it discharged, then you're not personally responsible for paying off the dues any more. In such a situation, your ex-husband should modify the mortgage on his own. You can sign a quitclaim deed and transfer the property to him with prior permission from the bankruptcy attorney.
