What can we do about a grantee, that after five years, still has not transfered the property into her name. The loan is still in my boyfriends name and she makes the payments directly to the lender. He's asked her several times, but thinks she can't get a loan. We are in California.

she and your boyfriend are on the loan and she is not willing to take over the property thinking that she will not be able to qualify for a refinance. why she thinks so? what is her credit score?

for transferring the property your boyfriend will have to create a deed. he can draft a quit claim deed form in which he will sign as the grantor and name her as the grantee. you need to make her believe that she can get a loan even if her credit score is not so good. there are many types of mortgages for people with average credit score also.

Legally you cannot do much to make her transfer the property in her name. But if she is making the payments then it is in her benefit to get complete ownership.

Hi Barbara,

Welcome to our forums.

From your query, I can make out that perhaps you have done quitclaim deed and transferred your property to another person (the grantee). The grantee may have not recorded the deed and that is why the title still shows your name as the owner.

It's not clear to me as to what exactly you are looking for. Is it that you want the lady to get her name on title? Perhaps you have asked her to refinance the loan in her name so that your boyfriend's name will be removed from the loan. I guess I am on the right track. But do correct me if this is not the exact situation.
