If the deficiency documents were not part of closing docs and I did not receive them, am I still responsible for balance of short sale.

I wrote in before about a short sale question. Chase bank has sent me a letter that was dated before closing. It is the deficiency letter. I did not receive this letter, nor was it part of the closing documents. The third page of the letter has only signature lines. That page was part of the closing documents and I signed it.

I am at a loss. I was very dilligent asking throughout the process that all will be paid in full and was told, absolutely.

I still have all the documents including those filed with the county that the loan was paid in full, but the wording on the deficiency letter is very clear that the remaining balance is my responsibility.

I have never recovered from this ordeal and am still unemployed. I believed I did everything I could do and did it with complete honesty and integrity. I feel raped.

Is it now time for bankruptcy? If so, I need a lawyer.

hi salvatoreascend,

after a short sale, you will remain liable for the deficient balance resulting from the sale of the property. it is strange that the lender did not inform you about it. before filing bankruptcy, you should request the lender to forgive the deficient balance resulting from the property sale. if the lender agrees to it, you won't have to file bankruptcy.
