can you tell me how to go about getting my name off of a mortgage when my ex-spouse do not wnat to buy me out and has refinanced the home and we cannot come to an agreement on any terms?
Also does is matter that my ex does not make any court dates nor answer any correspondence from my lawyer or myself?

If your ex-spouse has refinanced the mortgage in his name, then your name is removed from it. You will not be liable for the loan. If he is not present in the court on the given dates, then legal actions can be taken against him.

If your ex does not want to buy you out, then you cannot force him to do so. However, you can definitely take help of an attorney in order to sort out the matter.
