hi,
my husband and i are getting divorced. i bought the house with my credit, my money and everything. my husband has no credit, not job and wants to get his name of the mortgage and leave.he signed the divorce paper not wanting anything no property or cars. in the state of florida i had to put him on the mortgage, but he is not on the deed. how can i get him off the mortgage without having to refinance? he does not want me to lose the house, all he wants is to leave.

The mortgage is simply pledges the property as collateral for the loan. I'm guessing that he only signed the mortgage because of Florida's Homestead laws. You should not have to refinance the home if he was never on the original loan. I suggest you ask your divorce attorney if there is anything that you have to do.

You can assume the mortgage in order to get the loan transferred in your name. Once you assume the loan, your husband won't be liable for it anymore.
