As your ex-boyfriend is not ready to refinance or sell the property, you can file a partition law suit. Once you file the partition law suit, the court will sell off the property and the mortgage dues will paid from the price that is received. If the sale of the property results in an excess amount after paying the debts, then it will be divided between both of you.
