My sister received a Homesavers Advance and Dyck Oneal has the loan. she fell behind in the payments. She's worried they may take her tax refund, can they actually take her refund??

The lender can take the tax refunds in order to recover their dues in full. However, as far as I know, in order to garnish the tax refunds, the lender will have to file a lawsuit and get a judgment against you.

What does she plan on doing to get caught up? Homesaver Advance is a good program and that will help her get caught up without having to pay anything out. If she does not take care of any outstanding past due amount the lender may come after her to collect and could file a judgment, the likely hood of them taking money out of her account without authorization is unlikely. However, if she was set up for automatic withdrawal to pay her mortgage she may want to cancel that because lenders have been know to go in and take funds out of clients bank accounts and apply those funds to past due amounts. Either way she is responsible for the house and should make good some how.
