My total claim from Hurrican Ike is over $10,000.00. The first check the mortgage company released which repaired the roof only. Now I have over $9,000.00 worth of repairs inside and they will not release the second check, they have deposited it in my escrow. I need the money to make the repairs, I can not afford to be out of pocket anymore money.
Definately call an attorney.
Property destroyed by fire. Paying off mortgage with insurance claim. How long can mortgage co.legally hold balance owed to me? Meanwhile, they are still collecting mortgage payments from me? Is this legal?

The mortgage company will receive the dues only through the insurance check. They can't charge anything extra.
