can someone more o less tell how much wife will get?

marry in 9/2004. I sold my old separate property in 11/06 profit maybe $35,000, use old money plus old house profit to new house 1/2006, downpayment 150,000, owe 248,000 bought for 400,000 today appraisal is 355,000 and she did interspousal tranfer. I will devorce her due to she use me just to get uSA green card for her and two kids, hers only and she is bad person with lots of garbage including many affairs. can anyone help me calculate what is she going to get under the law. thanks

I am not clear about your question. Are you saying that you have an interspousal transfer and have added you wife's name on the deed? Which state are you living? The law varies from state to state to state. I think it will be better if you take help from an attorney regarding this.

Hi,

If it is a community property then the distribution of the share of property between you and your wife will depend upon who maid how much mortgage payments.

However even if it is not a community property, your wife will have her share of interest on the property as your wife has done an interspousal transfer.

Generally the divorce decree states who will get the property – whether it will be owned by both spouses or not. But if your wife does not claim anything, then you need not worry because in that case you need not give any share of interest to her. I think it will be better if you consult a lawyer in this regard.

Hello Gugu,

Did you sign the interspousal deed to add your spouse to the title of the property?

It is important to know the conditions placed in the deed. Does that have a joint tenancy?

Do you live in a community property state?

All this will determine how much your wife will receive.

Get an attorney right away. You are probably looking at difficult situation as it is and if she gets one you will definately need to know all your rights. In a situation such as this forums are good for support and general information but an attorney is a must for the battle ahead.
