what can I do about encrochment and fraud see below

my neighbor and I agreeded to switch some propety, he has built an addition on my property, bulldozed down trees as i have repeatedly ask him to stop until we switch property legally with a attorney. i have an attorney and my nieghbor continues to use my property. a surveyor used the old property line used with my mortgage contract, my neighbors says he has not encroached, had the same surveyor draw another survey up to that affect. How can this be done. My lawyer has asked my neighbor to get paper work done so land switch can be done. First of all how can land boundaries be changed by a surveys if he is going by contract survey done for mortgage company reversing what was submitted on first survey? what recourse and shouldn't my lawyer be doing something? i have agreement to switch property in writing by my neighbor.

Welcome to forums.

I have heard that surveys are done to determine the boundaries of properties. Land surveys help to establish and re-establish land boundaries with respect to the ownership of the real property.

I am not quite sure, but is it that you do not wish to switch the property? Please explain your situation clearly so that I can advice you further.

If your neighbor has in writing that the property can be switched, then I think he has the right to do so. But are you suspecting some kind of fraud being involved here?

dear sir,
i dont know who write my name on government land and i have elected as member of panchayat ,opposite party filed case of encrochment on me is it possible that i have to loose my membership. please clarify ,what stand i have to take.

I think you should talk to a real estate attorney asap as this is all about encroachment and perhaps some kind of property fraud.

what rights do I have to trim a very large (and messy) tree that hangs mostly over my side of the fence between my neighbor and myself?

You and your neighbor can negotiate in this regard and cut off the tree. I guess that will sort out the matter for you.
