2nd mortgage company has gone out of business

We had a 2nd mtg before we filed bankruptcy in 2002. The 2nd mtg. was made in 1999. We did not include our car or our 1st or 2nd mtg in the bankruptcy. Just credit cards due to a bad business decision. We continued to pay on the car, 1st and 2nd mtg. then about 4 months into it the 2nd mtg payments started coming back with "cannot forward". We have tried to locate them but could not "Money Centre in Charotte, NC". The County Accessor has tried to help but could not locate them either. We have tried to refinance so we could get rid of it and both banks could not find them to get a Subordination Agreement. It has been 15 yrs and the mortgage time is up as of 2/2013 and no one has contacted us or filed a lien against the property. We would like to sell our home but we don't have a clean title. Can you please give us some advice as to how we can get this? With the internet we have found out the Money Centre went out of business in 1999 and the company Altvia bought them. They are gone out of business and they never contacted us to let us know they might have the loan. We are at a loss. What do we do?

Well, you are in a tough situation in this regard. You should get in touch with a real estate attorney and take his opinion in this regard. You will have to somehow find out whether or not your loan was sold off to any other lender.
