You can get more than one loan modification provided you've severe financial hardship. You should contact your lender and he will check your financial situation and let you know whether or not you can qualify for a second modification.

i was told by my mortage co i cant i do have a server hard ship

Though your lender has said so, I will suggest you to re-apply for a loan modification once again. May be the lender will change his opinion and let you modify the loan.

Yes and No ... Some lenders will only allow 1 loan modification for the life of the loan, or may only only 1 every 12 months. If your previous loan modification WAS NOT the government HAMP (Home Affordable) program, then you will be able to apply for that program. Assuming your lender is participating in the program.
