my husband bought a house before we got married, about a year after we were married we refinanced the house, but my credit was better than his so we put the mortgage in my name alone, but both names are on the deed.we made a deal, that he would pay the mortgage payment and i would pay household bills and groceries.he lost his job about 2 years ago,and we got behind on the payments,we have tried loan modifications, and they give us the run around.i am moving out and we are getting divorced,i want my name off the mortgage, and the deed, because i want no part of the house, but now my credit is messed up.how do i get my name off the mortgage?i can get my name off the deed ,but i am still liable for the mortgage.what do i do?
Hi lilbarberette,
Your husband will have to assume the mortgage or refinance it in order to remove your name from the loan docs. However, in order to do so, he will have to show 2 years of stable employment history, steady income, good credit scores, etc.
Thanks

Since your name is in the mortgage document, you can't avoid the responsibility of paying the mortgage. As righly suggested by Hogg, your husband can assume or refinance the loan. But he has to meet certain conditions.
