We live in Vermont. My mother died recently. I own 2/3 of the house; my brother is a 1/3 owner on the deed. My brother is impossible to deal with..he won't pay any bills, or his share of the taxes. I offered him 1/3 of the value in cash and he refuses to even discuss the matter. I am thinking that because the value of the house is not great, I want to sue him myself in court -- I understand it is called a partition, and I just need to know what statute and to how to get started. I did consult an attorney and he said the cost would exceed $10,000. Can you just get me started? I want to buy him out, I do not want to sell the property. I just want to get him off the deed since he refuses to co-operate. This lack of cooperation has been going on for years (my mother was in a nursing home and he hasn't spoken to her since 2004, nor helped to pay any bills or keep up the "empty" house.) Thank you

It will be difficult for you to remove your brother from the property deed. Your brother will have to sign the deed in your favor in order to make you the sole owner of the property. If you file partition lawsuit, it will help you in selling the property. It won't help you in removing your brother from the deed. It will be better if you can ask your lawyer to deal with your brother in order to get the property transferred in your name.

im having almost the same problem. if i find something out ill glady pass it along, cause i know what a problem this can be.
