My mom is 85 yrs old. Her home was paid for. She got another mortgage on it about 15 yrs ago to purchase grandchildren cars. My sister has power of attorney and says, when my mother dies we will sell the house and pay off the load at the bank, but the grandkids are still going to have to make payments to her every month of the loan at the bank. The grandkids never signed any papers at the bank and their names are not on the load. What resource do the grandkids have to keep my sister from making them pay this load after my mom is gone? Can she sue them?
unless it is in writing probably not much anyone can do to anyone.
