My company attorney gave a preferred service request to the lender. The lenders trustee explained he was not aware of any preferred service request, and proceeded with service to the company's resident agent's address. The company is located in Maryland.

No lender has any obligation to give a preferred service. The preferred service option is available for the benefit of the customers because after everybody aims for customer satisfaction. However, if you find any lender offering preferred service, you can choose him/her because it can be expected that the service will be good.

Preferred services are not mandatory for a lender. They sometimes offer such services for customer satisfaction. However if you find such a lender, you should always do business there as the quality of the service will be better.

I don't think you guys understood my question! When my lender sent out a notice of intent to forclose, my attorney responded in dispute of the debt. My attorney further gave a preffered address for service to the lender, and explained that my company requested service for any forclosure proceedings to be sent to him (the attorney) or to my company at an address different from the address on file with the Maryland Department Of Assesments And Taxation. Is the Lender of the deed of trust required to forward that preferred service to his trustee when the trustee forcloses on the property. The lender and trustee both knew the resident agent address for my comany on file with the D.A.T. was not a valid address, and forclosed on the property without my knowledge. At a hearing the defense council stated that although my attorney gave preferred service to the lender, the trustee was not aware of this preferred service. I feel there should be a law that requires the lender to forward the preferred service to the trustee.

There is no such law stating the preferred service request. It is not even mandatory. But now as the defense council has stated that the trustee has not received the preferred service request, you can ask your lender to give the address to the trustee.
Yes, I agree with you that there should be a law so that the lender has to forward the request to the trustees.
