Can I get a mortgage and purchase a home without a legal separation agreement? My lawyer has been very slow with finalizing our agreement, and since I have nothing in writing can I move forward? We have now been separated for more than 1 year.
You may be able to buy a property without legal separation but I personally feel that it will be risky. You can ask your attorney take actions ASAP so that your separation gets legalized. Then you can take steps to buy a property.

I agree with what Niicss has said. It will be better to go for the property once you have been legally separated from your spouse.
