Quit claim deed

Can the quit claim deed applied for automotive property? Can I use the quit claim deed for a car propoerty under my ex-husbands and my name? I mean My husband and I get divorce and I am looking for an instance to help me to have my name taken away from the car title. He is having the car under his use, not me. What can I do?

Quit claim deeds are used for transferring real estate property title and can not be used for changing car ownership title.

You should contact your local Office of Motor Vehicles and fill up a Notice of Vehicle Transfer.

As Schecter said quit claim can not be used for transfer of automotive property.

Welcome omaz,

The quit claim deed cannot help you to take your name off the car title.

If you wish to take your name off the car title, then you need to contact the office of the Department of Motor Vehicles where the car is initially registered. You need to approach the office along with your ex-husband as both of your signatures are required.

A title application should be completed and submitted with the most current title along with a title fee of $4.00. If there is a lien on the car, then information on the lien should also be provided. Also, obtain a lease lien from the lien holder or lender with the year, vehicle identification number, lien amount and lien date as recorded on the title. There should also be a notarized signature of the lien holder or his agent.

However, if the lien is not paid off, then you should take permission from the lien holder for adding or deleting a name from the title.

You need the following documents for the transfer of car title:
  • Completed signed title application
  • Signed and notarized car title
  • Release of lien, if it paid off
  • Title and registration fees
  • Other documents like power of attorney (original or certified)
  • Written permission from lien holder if any lien is not paid off.

Car was registered in Texas. Title was Kansas. Gave car to Daughter, signed car over to her she drove it back to Calif. How do I get my name off car if she has not gone to title company yet.

Hi carol.

Welcome to the forum.

As helping user mentioned above that you should contact to the office of the Department of Motor Vehicles in your state where the car is registered. BTW is the car paid off? If not then you need to take permission from the creditor from whom you have taken the car loan before transfer the title.

My son is planning on going into bankruptcy and needs to buy a car for the right off. He was involved in a Florida real estate deal that was a fraud. Since he has not been making his payment on the property his credit score does not allow him to get a loan. How can we do it so that I buy the car with my good credit and get it in his name?

Hi Carol,

With bad credit your son cannot get a new loan in his name. You can co-sign on the loan to help him get a loan, in case his income is not enough to afford the loan. But you cannot help him with credit score. He needs to have at least 620 credit score in order to get a loan in his name.
