Quick Claim

Can some quick claim a mobile home? A friend tried to quick claim a mobile home to her ex-husband and when he tried to file the clain with the County Clerk he was told that the mobile home was not real property and couldn't be quick claimed. This was in Orange County Calif.

Hi Gjmac,

If it is on a permanent foundation and you own the land then it will be considered real property. The county office is right that a quit claim deed can be only used for transferring property title to which one has ownership.

If you own the land along with the mobile home then need to file an "affidavit of affixture" with the County Recorders Office to have the mobile home considered a real property.

Welcome gjmac,

When you record an Affidavit of Affixture with the County Recorder, it will add the mobile home value to the value of the land.

You need to give the following information along with the Affidavit of Affixture.
  1. Vehicle identification number of the mobile home.

  2. Legal description of the real property to which the mobile home is attached.

  3. The name of the holder of security interest in the mobile home and the original principal amount secured by the security interest.

  4. A written statement that the mobile home has not been taxed as personal property along with the name and address of the person to whom the last tax statement was sent.

  5. The location of the mobile home when it was last taxed.

my husband got us evivted from a mobile home park it fell out of escrow the day before it was suppose to close, can a Mobile Home be quick claimed?? by the dad ........

yes debbie, the mobile home can be quitclaimed. Did you sign on the deed and were you on the loan too?
