i own a home with my ex husband, he now resides in the home and pays the mortgage and i have moved into an apartment where i pay rent. the mortgage is in my name only, but both of our names are on the deed. he is unable to refinance to get the mortgage in his name, so we have to sell the house. he is leaving feb 21st and moving out of state, however his mother will continue to occupy the other side of the house (it is a duplex) until july 1st when she moves with him. what rights do i have if he stops paying the mortgage on the house once he has left the state? his items will still be in his side of the house until he comes back to get his mother.

As you are the one mentioned as the borrower of the mortgage, you will be liable for paying off the mortgage. If you don't make the mortgage, the lender will foreclose the property which will severely affect your credit report. It will be better to list the property in the market and ask your husband to remove his personal items from the property so that you can sell it off.
