Remove brother from rented property

Posted on: 18th Feb, 2013 01:27 am
Hi there… I stay in a rented property with my 2 kids. Out of compassion, I let my brother stay there… But he is creating nuisance. It’s bad for my kids. I have asked him to stay away from the property but he doesn't listen! He doesn't pay rent. How can I evict him from the property?
Hi Sissilove,

If your brother's name is not mentioned on the lease agreement, then he doesn't have any right to stay in that property. You may take legal actions in order to evict him from that property.

Thanks,

Jerry

As your have said that you stay in a rented property, the question of ownership does not arise at all - not for you as well as for your brother. If your brother's name is not there in the rental agreement, then he does not have any rights to stay in the property.

If your brother is not mentioned in the rental agreement of your rented property then you can easily evict him because he have no rights in your rental property.
You can take appropriate action against him.
