hauing just recently diuorced.In court heads of agreement were i got 70pc of eqtuity.he gets 301 JUST FOUND house being repossed as he has not paid.credit report shows mortgage on his new house and no actiue account onhouse under repossesion.how can this be ? is there anyway he could of swopped mortgage ? if this house was paid for cud he secure it against a loan or something ?

it shows that your ex was behind the mortgage payment and as per his agreement with the lender takes the ownership of the property. as a result, you don't have any rights on the property.
i personally suggest you to have a talk with that lender and try to find out any way. if you are in a position to make the mortgage payment, then you can request him to refinance the property in your name.

Has the house been already repossessed? If it is already repossessed then yo0u may get a redemption period to buy back the property. BTW do you want to buy the property back from the lender? Can you afford it?

if you had an ownership interest in the property to begin with, how is it that you would not know the status of the mortgage? even if he was handling all the payments (so to speak), wouldn't that information have come up in the discussions between you two and your lawyers and the judge?
